New Hampshire tightens rules around payer market exits

New Hampshire Gov. Kelly Ayotte has signed a bill that requires insurers to notify the state’s insurance department at least 90 days in advance before discontinuing a line of business, including Medicare Advantage plans. 

The bill specifically mandates that insurers inform the state before notifying consumers of any decision to stop offering MA plans in a county, terminate their contract with CMS, or significantly alter their plans. The legislation was driven by recent concerns over confusion caused by the withdrawal of MA plans in the state, which left seniors with limited options and inadequate time to choose new plans. 

The new law takes effect on Sept. 13.
