State legislative efforts to regulate or increase transparency policies around pharmacy benefit managers has continued throughout 2022, according to Mintz law firm.
In 2021 alone, 18 states passed or had legislation become effective involving PBM licensing or registration requirements. On the federal level, bipartisan legislation was introduced May 24 in the Senate that would give the FTC more power to regulate PBMs.
In addition, Louisiana's attorney general filed a lawsuit in April accusing UnitedHealth's PBM, Optum Rx, of inflating prescription drug costs in the state's Medicaid program.
