Private payers warned to comply with free federal contraception mandate

Top White House officials told private insurers to take immediate steps to ensure they are complying with no-cost contraceptive coverage options required in the ACA.

Payers are required to cover at least one form of contraception within each category identified by the FDA at no cost to plan members. 

There have been “troubling and persistent” reports of noncompliance with the requirements, according to the June 27 letter from HHS Secretary Xavier Becerra, Labor Secretary Marty Walsh and Treasury Secretary Janet Yellen. 

The officials did not mention the Supreme Court’s recent decision to overturn Roe. v. Wade, but said in the letter, “It is more important than ever to ensure access to contraceptive coverage without cost-sharing, as afforded by the ACA.”
