CMS to resume sharing Medicaid information with ICE

Medicaid information sharing with Immigration and Customs Enforcement officials will pick back up shortly, according to a Nov. 21 CMS notice.

“This notice announces CMS policy that CMS will provide certain information to ICE upon request from ICE consistent with federal laws to advance administration priorities related to immigration,” the document said.

ICE plans to request “biographical, contact and location information,” at the minimum.

The notice will be published in the Federal Register on Nov. 25, and its policies will take effect immediately. The current preliminary injunction will start tolling on that date and expire on Dec. 9.

HHS originally ordered CMS to share data with the Department of Homeland Security in June before establishing a formal agreement. State attorneys general secured a preliminary injunction in August blocking the initiative.
