Cigna, MultiPlan ask judge to toss underpayment suit

Cigna and MultiPlan are calling on a district judge to throw out an Employee Retirement Income Security Act lawsuit filed against them.

The initial suit alleges the companies sought to underpay for mental health and addiction treatments.

In a July 21 reply memorandum, lawyers representing Cigna said plaintiffs responded with "incorrect readings of the law, strawman arguments, and unrelated allegations" when the lawsuit was initially contested. 

MultiPlan's reply similarly claimed that the lawsuit failed to claim that the defendants were in violation of the Racketeer Influenced and Corrupt Organizations Act.
