Omaha, Neb.-based GS Labs, a currently nonoperational COVID-19 testing firm, is suing Aetna, alleging the insurer owes over $53 million for more than 100,000 claims related to COVID-19 testing services, according to an Oct. 6 court filing.
GS Labs accused Aetna of violating the Racketeer Influenced and Corrupt Organizations Act, along with other laws. The filing specifically accused Aetna of wire and mail fraud and embezzlement.
GS Labs is requesting that Aetna pay for lost profits and damages.
This is not Aetna’s first lawsuit of this type. Aetna Health of California had successfully defended itself against a suit brought by Saloojas, an out-of-network laboratory, after a judge determined the Coronavirus Aid, Relief and Economic Security Act did not allow a private right to sue.
