U.S. District Court Magistrate Judge Sean Flynn found that an award of $300,000 — equal to 37.5 percent of the class’s fund — was unreasonable given how quickly the case was settled, according to the report. Instead, he is recommending an award of $220,000, equal to 30 percent of the fund.
Humana was sued in May 2021 over a data breach that exposed the personal information of about 65,000 of its plan members. The lawsuit alleged Humana was negligent in informing those affected by the breach.
A joint notice of settlement was filed with the court in March, according to the report.
