A Massachusetts federal judge issued a preliminary injunction temporarily preventing Medicaid cuts to certain nonprofit reproductive health and abortion service providers for 23 plaintiff jurisdictions, according to a Dec. 2 ruling. The judge found the cuts, part of the One Big Beautiful Bill Act, failed “to provide clear notice,” making state compliance a challenge.
The One Big Beautiful Bill Act had set out a one-year funding moratorium for nonprofits serving predominantly low-income communities that offer these services and have previously reached a certain threshold of Medicaid payments.
Planned Parenthood immediately sued HHS to block the law’s implementation and won a preliminary injunction. Later, the organization and the federal government jointly acted to pause proceedings.
While Congress has prohibited the use of federal funds for abortions in many circumstances, the Social Security Act makes family planning resources mandatory under Medicaid.
