Humana to appeal Medicare Advantage star ratings ruling

Humana is not letting go of its 2025 Medicare Advantage star ratings case.

In the wake of the dismissal of Humana’s lawsuit with prejudice in October, the insurer announced plans to appeal to the 5th U.S. Circuit Court of Appeals in a brief, two-page notice filed Nov. 25.

Humana’s original complaint focused on CMS “secret shopper” calls. Humana argued the evaluation technique was not consistently executed properly and the “no-callbacks policy” is unlawful, hurting the payer’s 2025 star ratings. These ratings inform quality bonus payments.

Following a monthslong dispute over its ratings, Humana refiled the lawsuit in July.
