Medical testing lab countersues BCBS of Kansas City

Medical testing lab GS Labs has countersued Blue Cross Blue Shield of Kansas City, alleging the payer violated the federal Coronavirus Aid, Relief and Economic Security Act, a law that requires insurers to pay out-of-network providers for published costs, NBC affiliate KSHB reported Aug. 5.

The countersuit, filed Aug. 5 in the Western District of Missouri, comes after BCBS of Kansas City filed a lawsuit against GS Labs July 21 alleging it had filed $9.2 million in inflated claims related to COVID-19 testing.

The payer claimed GS Labs had charged $380 for tests that were a wholesale price of $20.  

GS Labs said in its countersuit that it had published the $380 fee for its rapid antigen tests online in accordance with the CARES Act.

"Blue KC's reference to alleged wholesale prices demonstrates its underlying contempt for the valuable services that GS Labs provided," court documents obtained by KSHB said.

GS Labs also said Blue KC violated the CARES Act by refusing to pay for COVID-19 testing.
